Who will judge the judges ? And what are they here to judge ? What training or expertise do they possess ? Do they even know law.
I am at an absolute loss to understand the role of the Chiefs of various courts in the dispensation of justice. Most of these are extremely eminent jurists and have held the highest possible positions not just in India but even globally.
In many of these cases – it is alleged that the individuals lacked basic ethics and values; had very little common sense (which they shielded with legalese), were technologically illiterate (ai !!!! Forget it) and most certainly cannot pass any paper in a JEE exam with the percentage required to get into a third rate engg college or even join a online program like the one offered by IITs (they need 85% percentile).
Let us look at three recent instances:
– justice Yashwant Sinha who I believe is honest and competent was framed in a case supposedly with a atm load of cash. The least the legal administration could have done is to order the police, CBI, PMLA, ED … whoever to investigate where that money came from, for what was it paid etc. Why was this not done ? Even in a small corruption case, this is all standard investigation and even a SHO of a police station would be hauled over the coals if he didn’t do it. Finally “motive” is key to punishment. Unless here the stand is that no crime ever happened. And no money was actually there (there is no confiscated note – even a torn one)
– there is a book which was not even printed where one page in a proof copy had a statement that corruption in the judiciary is a challenge. Of course it is. Ask any indian citizen and show me one educated person (not a judge) who will say it is not. But instead of working to clean up the act, the Legal establishment came down so heavily so as to ruin the poor well meaning professor. As if he had nothing better to do.
– then there is this cockroach business which is viral all over the internet. What is the establishments view on the tens of thousands of unemployable lawyers crowding every court of India so much so that toilets don’t work and there is no space for litigants to even stand. What animal species are these ?? Of course, these are our future judges. So they should be allowed to learn.
At the same time, these very supposedly “useless” courts like the one in Allahabad are asking the most profound questions. With huge upsides. One judge has yesterday asked the government as to who was giving licenses and guns to the Bahubalis of Up. Another is asking that why the poorest pay the highest rate of interest inspite of the govt guaranteeing repayment in the case of msme companies.
Yet Justice Varma is not sacked, not interrogated, not jailed, not even questioned …. But transferred to Allahabad High Court. As if it is a garbage bin.
