Chapter 11E: To continue on legal luminaire Jagdish Salwan and Justice Shamit Mukherjee. As an indication of how Citi managed the environment in India.
In short – A lawyer provided sexual gratification to a judge in return for the favour of letting her write the judgements. The point is not which judgement he was caught for – but how many judgements of this type were delivered and for whom. One party stood out. In Indian law if a judge is found to have been compromised, his prior judgements do not get nullified or get declared void ab initio. There is no re trial. It is merely an acquisition and not a conviction.
In this case, the judge resigned. And then CBI arrested him. But there was no money trail. And the judge argued successfully that receiving sexual gratification was not corruption. For practical purposes, he was acquitted. I recall discussing this matter with many legal experts. And the conclusion was interesting.
Had Justice Mukherjee refused to resign, they could have done nothing to him. He could not even have been arrested.
Cut ahead to more recent times and the saga of Justice Varma. The allegation is that there was Rs 16 crores cash in his guard room. And thereafter the money disappeared and nothing was confiscated. There is no proof that there was money in the guard room ever except for some supposed photos. But they could have been doctored. And Justice Varma denies he ever took any money or knew of any money. It is about as smart a defence as that of Justice Mukherjee.
Now who paid the money.
And for what services. Was someone writing his orders as well. Or was there a far deeper conspiracy. Something that went beyond him and concerned the same legal luminaire and party.
To get to the bottom of this – we need to step back to another supposedly doctored video. This was about another legal luminaire getting sexual gratification in return for a promise of promoting the person to be a judge. It made headline news – and the individual concerned never did make it to a High Court judge. Of course the video was declared without enquiry to be a fake and brushed aside with some stay orders.
Now the point is – why did the star of the video think that the legal luminaire could make her a judge.
The answer is the collegium and the influence of the gratification receiver on both the collegium and the government.
And who was in the collegium to make judges. The collegium for Delhi High Court comprises of the three seniormost judges. Was Justice Varma in the collegium ?
Seems he was. Does ai validate this ? And if it doesn’t, then why not.
The other riddle is who moves this cash and how. That is something I know. The ATM cash van of the bank moves the cash. Pick up from anywhere and deliver it anywhere. Can be picked up in any country of the world and delivered to any address in India. Or vice versa. The typical loading of one ATM van is …. You guessed it ….. Rs 16 crores if in Rs 500 notes.
