Can a judge pass judgements on his own honesty. Social media and ai are also accessible to class 8 or even class 2 kids.
In that case why not have a judicial system based on self assessment and self trial. Why do we need law enforcement or courts at all ? Why do have media ? Or for that matter, why do we even need police.
There are basic cardinal principles. In a company, an interested director cannot vote on his own appointment or his own salary.
Order any market study. Ask anyone on the road, if there is corruption in the judiciary or not. And if it is omni present. The fact is that corruption is a challenge in not just the judiciary but also in the bureaucracy, the political leadership and even in the religious institutions and temples. Corruption is a nationwide challenge.
It is not just corruption in the form of bribes but also corruption in the form of inaction, not working to the best of your ability etc. of course there are exceptions.
But there is a reason why they are called exceptions. Because that is what they are.
Padmashri Prof Danino is a naturalized Indian citizen of French origin. He has done brilliant work on ancient Indian history. He teaches at IIT Gandhinagar. I have his book “The Lost River. On the trail of the Saraswati.” It’s absolutely amazing.
The Supreme Court has directed the Centre and all State governments along with all institutions receiving public funds, either partially or fully, to dissociate the chairperson of NCERT social science curriculum, Professor Michel Denino and his two other associate members who were behind the Sub-chapter in part 2 of the Class 8 NCERT Social Science textbook ‘Corruption in the Judiciary’, in any manner for the purpose of preparation of curriculum or finalisation of text book for the next generation.
A bench led by the Chief Justice of India (CJI) Surya Kant also directed all of the aforesaid authorities to disassociate Professor Denino, along with his team, from the preparation and inclusion of the Chapter, from rendering any service in any institution, which would mean payment to them from public funds.
Now let’s see the actual situation. A total of 32 hard copies have been distributed to date. How many students have read this if at all. A gentle nudge could have been issued to review the contents. The NCERT is neither a private body nor a foreign one. They would have made changes.
Isn’t it a case of judicial activism ? Will such a step improve the perception of judicial corruption. Or would it further damage the non existent credibility of the judicial system.
This also raises a far more serious issue. One of constitutional rights and freedom of expression. Can we not even churn the pot or stir up a debate?
A bigger question. What has the judiciary managed to do to social media or to ai which are also accessible to class 8 kids. Ask any ai and it will say all kinds of things about Indian judiciary.
Offence best form of defence.
Or does it indicate guilt?
