Who needs justice ?
The judge or the parties who got sold out.
First and foremost I do not believe Justice Varma is corrupt or compromised. What seems to have happened is that another judge of the court was using his outhouse as a trans shipment point to take money from a service seeker and to hand it over to the cash van of a foreign bank who would then credit some overseas account. The name of the lady judge and the client who paid are supposedly open knowledge.
But that is not the point.
There is a far bigger issue involved. Either the judge is declared to be honest and all the false charges on the honourable judge are dropped.
And if they are not dropped and the judge is believed to have been compromised then ALL THE JUDGEMENTS of this judge should be SET ASIDE.
Let me give you a directly relevant example. Way back in 2002-3, I was on the Board of a company which had a shareholder dispute. The foreign bank head who was on the Board used to boast that the child, parent or mistress of every judge was on their payroll. In the impugned matter, they had obviously briefed the judge. Both the copies of the lawyer and the judge had fluorescent coloured fingers. The lawyer would say “please go to page 151” and in one flip the judge would go to page 151. The judges page had a green finger and so did the arguing lawyer.
But wait.
I saw that the lawyer standing next to me even had an order copy in his file. How could he have got the order copy of a case which was yet being argued. A young lady lawyer standing next to him was pointing out paragraphs from what looked like the order sheet. My colleagues took note. We got an adverse order four days later. I had already seen the first page of the order four days ago.
The game was over.
The judge was Justice Shamit Mukherjee of Delhi High Court and the name of the lady lawyer can be found on Google. It was a scam way bigger than Justice Varna. Whilst the jury is still out on Justice Varma, here it was an open and shut case. For example he may have got cash for selling an ancestral property.
The lady worked for the foreign bank in question, wrote out the judgements for the judge, provided him sexual gratification. And then the judge proclaimed the judgements. It was as simple as that. It was being done daily. Three orders a day. And everytime the bank would win regardless of the facts. The judge resigned (he was not sacked). He even justified the need for sexual gratification and linked it to work pressures etc. the matter went to court.
Now guess what.
Receiving sexual gratification is not corruption. He was never ever convicted of corruption. After a while, the matter died out.
The aggrieved parties went to court seeking reversal of the obviously faulty orders. Judges in the appeal benches ganged up to support the winning party. No judgement was overturned. There was no corruption. There was no denial of justice.
All is well.
So why all this noise now.
